Appeals Court Temporarily Halts Ruling on Obamacare’s Preventative Care Mandate

A federal appeals court in New Orleans has granted an “administrative stay” on Monday, pausing a federal judge’s ruling that struck down a crucial part of the Affordable Care Act (ACA) requiring insurers to cover preventative care services such as vaccines, cancer screenings, diabetes tests, and HIV screenings.

The 5th U.S. Circuit Court of Appeals issued the stay without providing any comment. The ruling in question was made on March 30 by U.S. District Judge Reed O’Connor of Texas.

Biden Administration Seeks Stay and Appeals Ruling

Responding to the March 30 decision, the Biden administration had requested a stay as they prepared to appeal the ruling. In court filings, administration lawyers argued that the decision would have a significant impact on the preventive care received by approximately 150 million individuals.

The stay granted by the appeals court provides temporary relief while the administration’s appeal is underway. It ensures that the preventative care mandate remains in effect during this time.

Judge O’Connor’s Previous Ruling and Background

Judge O’Connor, who was nominated by former President George W. Bush, had previously ruled more than four years ago that the entire ACA was unconstitutional. However, the U.S. Supreme Court overturned that ruling later on.

In his March ruling, O’Connor specifically blocked the requirement for most insurers to cover a range of preventive care services. This decision was considered a victory for the plaintiffs, including a conservative activist in Texas and a Christian dentist who opposed mandatory coverage for contraception and an HIV prevention treatment based on religious grounds.

The appeal process is still in its early stages, and the appeals court has not yet scheduled a date for arguments. As the case progresses, it will be closely monitored due to its potential impact on the accessibility and coverage of preventative care services for millions of Americans.

The preventative care mandates are established based on recommendations from the U.S. Preventive Services Task Force, a group of volunteers. Judge O’Connor’s ruling claimed that enforcing these recommendations violated constitutional language regarding the appointment of government officials.
