Toxic Foam in Philips Devices Sparks Class-Action Suit
Dutch healthcare giant Philips is set to face a European class-action lawsuit over the use of toxic foam in its sleep therapy devices and mechanical ventilators. The foam, which was used to reduce noise from the electrical engine, has been linked to health risks and potentially lethal illnesses.
Compensation for Over 1.2 Million Users
The class action, filed by the Global Justice Network and Italian consumer association ADUSBEF, seeks compensation for over 1.2 million users of Philips’ medical devices. Claimants are seeking at least €70,000 per person for emotional distress and other damages.
Foam Degrades into Toxic Powder
The foam, made of polyester-based polyurethane (PE-PUR), degrades into a sticky powder when it deteriorates. This powder has been linked to carcinogenic properties and can cause potentially lethal illnesses. “People have been inhaling this powder made of a toxic substance which is carcinogenic and can lead to potentially lethal illnesses,” said Stefano Bortone, president of Global Justice Network.
Philips Recalls Devices and Settles US Lawsuit
In June 2021, Philips issued a field safety notice for some respirators due to the potential health risks. The company subsequently recalled the devices globally and agreed to a $1.1 billion settlement in the US for people who claimed they were injured by the use of the respirators. However, Philips did not admit fault or liability for the injuries.
New Class-Action Aims to Compensate European Users
The new class-action lawsuit aims to properly compensate European users for emotional distress and physical damages. “We want to be sure that everyone who has the right can participate in the action,” said Bortone. The class action was filed under the 2020 EU directive on representative actions, which allows European citizens to file collective actions for a class of consumers.
