France has intervened in the pending cybersecurity certification for cloud services (EUCS) by requesting a legal opinion from the Council’s legal service, delaying the agreement among member states. The purpose of this inquiry is to gain clarity on how the adoption of EUCS would impact existing national schemes, particularly France’s SecNumCloud developed by the French National Cybersecurity Agency (ANSSI).

Delay in Approval

The EU scheme, which was initially set to be approved by April 15, faces a postponement as a result of France’s request. This delay pushes the potential approval to the upcoming expert group meetings in May or June. The European Cybersecurity Certification Group (ECCG) is currently addressing France’s concerns and evaluating the implications of EUCS adoption on national cybersecurity frameworks.

Long-standing Discussions

Discussions surrounding a voluntary certification scheme for cloud services have been ongoing for three years, following the European Commission’s directive to ENISA in 2019. The aim is to establish a certification process that allows companies to demonstrate compliance with cybersecurity standards, ensuring the adequacy of ICT solutions for the EU market.

Sovereignty Concerns

France’s push for sovereignty requirements in the EUCS text has been met with resistance from other EU countries and industry stakeholders. These requirements, aimed at excluding non-EU cloud providers from accessing the highest security options, were omitted from the latest draft proposed by ENISA. The absence of sovereignty provisions has prompted calls from EU companies, including Airbus and Orange, for their inclusion to safeguard European interests.

Industry Advocacy

Several EU companies have advocated for the inclusion of sovereignty requirements in the EUCS proposal, emphasizing the importance of protecting European interests and ensuring cybersecurity resilience. This advocacy reflects broader concerns within the EU regarding data sovereignty and cybersecurity, underscoring the complexity of negotiations surrounding the certification scheme.
